Supreme Court Hears Oral Arguments to Restrict Access to Medication Abortion

(Washington, DC) – Today, the Supreme Court heard oral arguments concerning access to Mifepristone, the initial pill in a two-pill regimen used for medication abortions. This marks the onset of a pivotal moment as the Supreme Court deliberates on two abortion-related cases this term, set to have profound implications for abortion and miscarriage care nationwide.

Mifepristone, a safe and widely utilized medication, has seen a shift towards online prescription and mail delivery since becoming more accessible in 2016. However, with the potential for further restrictions on abortion care, medical experts anticipate a concerning increase in maternal mortality rates. Such decisions have the potential to deepen existing socioeconomic and racial health disparities, while also posing a significant risk to the authority of the FDA and its approved medications.

Until the Supreme Court releases its opinion, expected around June, there will be no alterations in the distribution of Mifepristone.

In response, Martha Sanchez, Director of Health Care Policy and Advocacy at Young Invincibles said:

“Access to safe abortion care is essential health care. This case comes after several restrictive abortion laws have gone into effect across the nation, posing a significant threat to reproductive care and the well-being of women. The Supreme Court must rule with the health and safety of patients in mind and protect access to Mifepristone.

If access to Mifepristone is restricted, it will have detrimental impacts on abortion and miscarriage care, exacerbating the already extreme limitations posed for reproductive health care. We cannot allow political actors to overrule the authority of the FDA and restrict access to important medication.”
