Virginia Judge Rules Against The Minimum Coverage Requirement

 

[RICHMOND, VA] – With 14 federal judges already having rejected challenges to the
Affordable Care Act, Judge Henry Hudson became the first federal judge to find one
part, the minimum coverage provision, unconstitutional. His ruling, if upheld, would
threaten the coverage of millions of young Americans. Importantly, however, Judge
Hudson ruled against Virginia Attorney General Ken Cuccinelli on the “severability
issue,” allowing the law as a whole to stand. Moreover, the minimum coverage ruling
will be appealed and full implementation is expected to move forward as planned.
