Preliminary Injunction Blocks DACA Recipients Eligibility Under the ACA  

(Washington, DC) – Judge Daniel M. Traynor of the U.S. District Court in North Dakota ordered a preliminary injunction blocking certain DACA recipients and other eligible individuals’ access to the Affordable Care Act. This injunction impacts the 19 states that challenged the Biden administration’s Final Rule, including Kansas, North Dakota, Alabama, Idaho, Indiana, Iowa, Missouri, Montana, Nebraska, New Hampshire, Ohio, South Carolina, South Dakota, Tennessee, Virginia, Florida, Arkansas, Texas and Kentucky.

In response, Martha Sanchez, Director of Health Care Policy and Advocacy at Young Invincibles said:

“This injunction is a cruel and misguided attack on young people, most of whom have lived in the U.S. for a majority of their lives. We are once again putting politics over the well-being of people and compromising their access to health care. DACA recipients have waited far too long to access the same health care options as others, despite contributing to our communities and economy every day. Young Invincibles is disappointed and disheartened by this challenge, but will continue to fight for access to health care under the ACA and uplift DACA recipients’ voices.”
