Healthy Young America App Promotional Sweepstakes
OFFICIAL RULES
Please read these “Official Rules” of the Healthy Young America App Promotional Sweepstakes (the “Sweepstakes”). You must accept and agree to these Official Rules to participate in the Sweepstakes. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THE SWEEPSTAKES. A DONATION, PURCHASE, OR DOWNLOADING OF THE APP WILL NOT IMPROVE YOUR CHANCE OF WINNING. ODDS OF WINNING ARE ESTIMATED TO BE LESS THAN 1 OUT OF 100,000, BUT ACTUAL ODDS WILL DEPEND ON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED DURING THE SWEEPSTAKES PERIOD. VOID WHERE PROHIBITED BY LAW. AGREEMENT TO BE BOUND BY THE OFFICIAL RULES: By entering the Sweepstakes, you accept and agree to these Official Rules and the decisions of the Sponsors, which are final and binding in all matters related to the Sweepstakes. Winning the Prize is conditioned upon fulfilling all of the applicable requirements set forth in these Official Rules. No exceptions or substitutes will be made. SWEEPSTAKES PERIOD: The Sweepstakes begins at 9:00 a.m. Eastern Standard Time on Thursday, March 6, 2014, and ends at 5:00 p.m. Eastern Daylight Savings Time on Friday, October 15, 2014 (“Sweepstakes Period”). ELIGIBILITY: The Sweepstakes is open to individuals residing in any of the 50 United States, including the District of Columbia, who are at least 18 years of age on the date of entry. The Sponsors’ directors, officers, employees, vendors, and their immediate family members (spouses, siblings, parents, and children) of the Sponsors are not eligible. The Sweepstakes is void in Puerto Rico and US Commonwealths, Territories and other jurisdictions (including overseas military installations), and where otherwise prohibited by law. To be eligible for the Prize, you must satisfy all of the applicable requirements set forth in these Official Rules. PRIZE DESCRIPTION: 1 cash prize of $1,200 (the “Prize”) will be awarded to the winner of the Sweepstakes by check or money order. Retail value: $1,200. Odds of winning are estimated to be less than 1 out of 100,000, but actual odds will depend on the number of eligible entries received during the Sweepstakes Period. The winner will be responsible for all taxes owed on the Prize, including, but not necessarily limited to, federal, state, and/or local income taxes. See “Winner Selection and Verification” below for additional details. HOW TO ENTER: There are 2 ways to enter: 1) Download for free the Healthy Young America app using your Apple® or Android® device, complete all required sections of the Sweepstakes entry form via the app, and press “submit.” Or 2) As an Alternative Method of Entry, on a plain 3” X 5” index card, legibly handprint or type your first name, last name, date of birth (DOB), complete address, city, state, zip code, phone number, and email address and mail your completed 3” x 5” card to: Young Invincibles Healthy Young America Sweepstakes Entry 1411 K Street, 4th Floor Washington, D.C. 20005 LIMIT: 1 ENTRY PER PERSON. WE ARE NOT RESPONSIBLE FOR ERRORS THAT MAY OCCUR IN SUBMITTING AN ENTRY, INCLUDING LOST ENTRIES. ALL ENTRIES MUST BE RECEIVED OR POSTMARKED WITHIN THE SWEEPSTAKES PERIOD. In the event more than 1 entry is received from an individual, the first entry processed will be considered the only valid entry received. The potential winner may be required to provide government-issued identification to receive the Prize and must satisfy the other eligibility requirements stated in these Official Rules. WINNER SELECTION AND VERIFICATION: A potential winner will be selected in a random computer drawing conducted on or about November 1, 2014, from among all valid entries received. No later than November 30, 2014, Sponsors will notify the potential winner that he or she has won the Sweepstakes and may require the potential winner to submit evidence of eligibility. If the Prize is refused, a Prize notification is returned or deemed undeliverable, or the potential winner is disqualified for any reason, an alternate winner will be selected via a random computer drawing. PUBLICITY: Except where prohibited by law, participation in the Sweepstakes constitutes the winner’s consent to Sponsors’ and their agents’ use of the winner’s name, likeness, photograph, voice and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. SPONSORS: Young Invincibles and Center for Community Change (“Sponsors”) 1411 K Street, 4th Floor Washington, D.C. 20005 202-534-3560 questions@younginvincibles.org GENERAL CONDITIONS/RELEASE: By participating in the Sweepstakes, you (a) release Sponsors, their respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by your participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the Prize; and (b) acknowledge that the foregoing parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the Prize including, but not limited to, its quality or availability, or suitability. Neither Sponsors nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost/delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any on-line service or Website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected communications, or any injury or damage to your or any other person’s computer related to or resulting from participation in the Sweepstakes. Failure to enforce any term of these Official Rules shall not constitute a waiver of that term. If for any reason the Sweepstakes is not capable of being executed as planned, or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes that, in the opinion of Sponsors, corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsors reserve the right at their sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Sweepstakes. In the event of any cancellation, termination, or suspension, notice thereof will be posted at www.younginvincibles.org/hya-app-sweepstakes and the determination of the winner will be made from among all eligible, non-suspect entries received as of the date of the termination, cancellation or suspension, as Sponsors determine in their sole discretion. Entries not complying with these Official Rules are subject to disqualification by Sponsors. DISPUTES: By participating in the Sweepstakes, you agree that (a) any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the District of Columbia; (b) any and all claims, judgments and awards shall be limited to the actual reasonable and necessary out-of-pocket costs you incurred to enter the Sweepstakes, but in no event attorneys’ fees or costs or any other cost not related to your entrance in the Sweepstakes; and (c) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, except out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations as a participant in the Sweepstakes, or the rights and obligations of Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the District of Columbia, without giving effect to any choice of law or conflict of law rules (whether of the District of Columbia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other the District of Columbia. WINNER’S NAME: For the name of the Sweepstakes winner, mail a stamped self-addressed envelope to: Sweepstakes Winner’s List, Young Invincibles, 1411 K Street, 4th Floor, Washington, DC 20005. Requests must be received by January 31, 2015.
